Under the influence of alcohol or drugs, there are two convictions you can get; a DUI or a DWAI. For a DUI, your blood alcohol level cannot be over .08, whereas anything around .05 BAC will land you with a DWAI. If you are under the age of 21, your BAC limit is .02.
After you have been pulled over and are suspected of being under the influence, your first thoughts likely race to the potential consequences you are facing. What will happen if you are convicted? Reasonable suspicion means that a police officer must have a reason to believe that you are under the influence of a substance. If you did not actually break a traffic law, the officer may not have had a reasonable reason to suspect you of being under the influence and therefore should not have pulled you over.
